Medical Records In A Social Security Disability Case

Medical Records In A Social Security Disability Case

At our law firm, we’ve noticed that one of the biggest factors in whether you will win or lose your social security disability case is your medical records.  If you are getting treatment for severe mental or physical conditions that keep you from being able to work, then you are supposed to get social security disability benefits.  But if the social security administration doesn’t have a copy of your medical records, then there is no evidence to support your case.

The Social Security Administration tells everyone that if you will just give them a list of your doctors, they will collect all of the records for you.  But that doesn’t always happen.  It’s pretty common for some of your records to be missing from the file.  In order to deal with this problem, it’s important for you to keep a good list of all of the doctors that you have seen.  You will want to get a copy of your medical records from each one of these doctors and give a copy to the Social Security Administration.

Doctors are supposed to give you a copy of these records for free if the request is related to a social security disability claim.  So it shouldn’t cost you anything to get these records into evidence.  And you want to do that because your medical records are so important to the outcome of the case.

In our office, we do this for each of our clients.  We make a list of all of the doctors you have seen, and we get copies of the records and submit them to the SSA.  That is one of the most important things we can do to help our clients win their case.
